1. Acceptance of Terms

By creating an account on Prospekt, you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the platform.

2. Description of Service

Prospekt is a free lead generation platform operated by MASVX. The platform allows you to search for local business leads via the Google Places API and send outreach emails via your own API keys (e.g., Resend). Prospekt is a “bring your own keys” (BYO) platform — we provide the interface and workflow, you provide the API credentials.

3. Account Responsibilities

  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all API keys you provide and any costs incurred on your own API accounts (Google, Resend, etc.).
  • You are responsible for the content of any emails you send through the platform.
  • You are responsible for complying with all applicable laws and regulations.

4. Acceptable Use

You agree not to:
  • Send spam, unsolicited bulk email, or any content that violates the CAN-SPAM Act.
  • Use the platform for any illegal activity.
  • Scrape data beyond the scope permitted by the Google Places API terms of service.
  • Harass, threaten, or abuse any individuals or businesses.
  • Violate GDPR or other applicable data protection regulations.
  • Attempt to reverse-engineer, disrupt, or exploit the platform.

5. API Keys

  • You provide your own API keys for Google Places and email sending (Resend).
  • Your API keys are stored securely using encryption.
  • We do not use your API keys for any purpose other than executing actions you initiate on the platform.
  • You are solely responsible for any costs incurred on your API accounts.

6. Data & Privacy

  • Your leads, emails, templates, and campaign data are yours.
  • We may collect aggregate and anonymous usage data for platform improvement.

7. Email Compliance

  • You must comply with the CAN-SPAM Act and all applicable email regulations.
  • Commercial emails must include a clear unsubscribe mechanism.
  • You must honor opt-out requests within 10 business days.
  • You must include a valid physical postal address in commercial emails.
  • Email subject lines and headers must not be deceptive.

8. Limitation of Liability

The platform is provided “as is” without warranties of any kind, express or implied. MASVX is not liable for:
  • Email deliverability or bounce rates.
  • Costs incurred on your API accounts.
  • Accuracy, completeness, or reliability of lead data.
  • Any damages arising from your use of the platform.
  • Service interruptions or data loss.

9. Termination

  • We reserve the right to suspend or terminate accounts that violate these terms or engage in abusive behavior.
  • You may delete your account at any time through the platform settings.
  • Upon termination, your data will be deleted in accordance with our Privacy Policy.

10. Changes to Terms

We may update these Terms of Use from time to time. Continued use of the platform after changes constitutes acceptance of the updated terms. We will indicate the date of the most recent update at the top of this page.
